What is Medicaid?

Medicaid is the only government program that pays for long term custodial nursing home care. It has complicated asset and income tests, designed to insure persons qualifying for such care have minimal assets, generally $2,000 or less. If an applicant is married, we can insure the “community” spouse remaining at home retains the largest possible share of the couple’s assets and income. We can also help an institutionalized spouse “spenddown” in a smart way to best protect the community spouse, if applicable, and insure Medicaid eligibility for the institutionalized spouse at the earliest possible moment.

What About Estate Recovery and the Family Home?

Like other states, upon the death of a Medicaid recipient, Utah seeks to recover the value of Medicaid services provided, though they generally do not do so if the institutionalized spouse is survived by a community spouse. We can help minimize estate recovery claims and retain the family home to the extent possible.
